versus
UNION OF INDIA & ANR. ..... Respondents Through: Mr.Ajay Gupta, Sr. Central Govt. Counsel for R-1 & R-2.
CORAM:
HON'BLE MR. JUSTICE NAVIN CHAWLA
O R R% 21.09.2020
This petition has been heard through video conferencing.
CM APPL. 23294/2020 (Exemption)
Allowed, subject to all just exceptions.
W.P.(C) 6702/2020 & CM APPL. 23293/2020
The learned counsel for the petitioners submits that the case of the petitioners is covered by the judgment dated 04.11.2019 of this Court passed in W.P.(C) 9088/2018, titled Mukut Pathak & Ors. v. Union of India & Anr.
The learned counsel for the respondents, however, submits that the petition is liable to be dismissed on the ground of delay and latches.
I do not find any merit in the objection raised by the learned counsel
for the respondents. Coordinate Bench of this Court, in its judgment dated 02.09.2020 passed in WP(C) 5490/2020, titled Sandeep Agarwal & Anr. v. Union of India & Anr., has already rejected such submission.
In view of the above, the present petition is disposed of in terms of the
abovementioned judgment of this Court in W.P.(C) 9088/2018, titled Mukut Pathak & Ors. v. Union of India & Anr.
