1.The Writ Petition under Article 226 of the Constitution of India readwith Section 482 of the CrPC has been filed on behalf of the petitionersseeking quashing of FIR No.104/2023 dated 10.02.2023, under Sections498-A, 406/34 of the Indian Penal Code, registered at Police StationGovindpuri, District South, Delhi.

2.Learned counsel on behalf of the petitioners, submits that the partieshave amicably settled their disputes in the Delhi High Court Mediation andConciliation Centre, vide Settlement dated 01.05.2024.

3.Learned counsel for the respondents, has an objection to quashing ofthe FIR, on two grounds. Firstly, this is Petition, where quashing wassought on merits and secondly, case of Domestic Violence Act, has beenfiled by the mother of the petitioner No. 1, is still pending in the Court of

Bharatpur, which has till date not been withdrawn. According to the learnedcounsel for the petitioner, the Petition of Domestic Violence Act in theCourt of Bharatpur, has been withdrawn.

4.Learned counsel for the respondent No. 2 insists that the Petition isstill pending in the Court of Bharatpur.

5.Learned counsel for the petitioner, seeks permission to withdraw thisPetition with liberty to file afresh, in terms of the settlement arrived atbetween the parties. Learned counsel further submits that in case, the Caseof Domestic Violence Act in the Court of Bharatpur, is not withdrawn, itwill be done within seven days.

6.In view of the submissions made, the Petition is permitted to bewithdrawn with liberty as prayed for.

7.The Petition is disposed of accordingly.
