1.The present writ petition has been filed under Article 226 of the Constitution of India by the petitioner forum seeking directions to respondent authorities to provide, residents of their village i.e. Kham Pur Village, for park/playground, primarily, for use of senior residents as well as for the children of their village.

2.The petitioner forum is constituted by senior citizens of Village Khampur, North West Delhi which is stated to be one of the oldest and

regularized villages of Delhi having population of more than 4,000 people. It is submitted that despite request already made in this regard, they have not received any response from the respondents. It is submitted that providing playground or park or garden, in regularized colony, is nothing less than Fundamental Right and, therefore, it is prayed that respondents may be directed to take necessary steps towards making provisions of park/playground in the Village Khampur.

3.Learned counsel for respondent authorities appear on advance notice. The respondents in the present petition are Delhi Development Authority (DDA), Municipal Corporation of Delhi (MCD) and Chief Executive Officer, Delhi Parks and Garden Society, Government of NCT of Delhi.

4.After hearing both the parties, the present petition is disposed of with direction to respondent nos.1 and 3 to treat the present writ petition as representation and to dispose of the same within period of six weeks from today.

5.Needless to say, in case the petitioner forum is still aggrieved by the outcome of such representation, it would be at liberty to file appropriate petition in accordance with law.

6.The petition stands disposed of, accordingly.
