1.The fact of the death of the petitioner has been verified by the State.

2.Status report in this regard has been handed over by the learned Additional Public Prosecutor for the State to this Court and the same is taken on record.

3.The death certificate indicates that the petitioner expired on 12.09.2024.

4.The present petition was filed challenging the order dated 06.11.2017, passed by the learned Appellate Court, in Crl. Appeal No. 177/2017, whereby the appeal filed by the petitioner against order of conviction dated 22.06.2017 and order on sentence dated 01.08.2017, passed by the learned Trial Court, in CC No. 291939/2016 arising out of FIR No. 317/2015, registered at Police Station IP Estate, was dismissed.

5.By the order dated 22.06.2017, the petitioner was convicted for the offences under Sections 354/506/509 of the Indian Penal Code, 1860 (‘IPC’).

6.By order on sentence dated 01.08.2017, the petitioner was sentenced as under:

a.to undergo rigorous imprisonment for period of one year and to deposit fine of ₹10,000/- for the offence under Section 354 of the IPC, and in case of non-payment of fine, to further undergo simple imprisonment for period of 10 days; and

b.to undergo simple imprisonment for period of six months and to deposit fine of ₹1,000/- for the offences under Sections 509 and 506 of the IPC respectively, and in case of non-payment of fines; to further undergo simple imprisonment for period of 5 days respectively.

c.All the sentences were directed to run concurrently.

7.Since the petitioner has expired during the pendency of the present case, the proceedings stand abated.

8.The petition is therefore disposed of in the aforesaid terms.
