1.Allowed, subject to all just exceptions. CRL.M.C. 214/2024
2.This petition has been filed seeking quashing of FIR No. 0374/2019 registered at Police Station: Vivek Vihar, Shahdara, Delhi under Sections 498A/406/34 of the Indian Penal Code, 1860 (in short, ‘IPC’).
3.The parties have entered into settlement and have executed Settlement Deed dated 15.12.2020, recording the terms thereof.
4.The respondent no. 2 is present in person in Court and has been duly identified by the IO. She submits that the dispute between the parties has been settled and she does not wish the criminal
proceedings be continued any further.
5.Keeping in view the above and the principles laid down by the Supreme Court in Gian Singh v. State of Punjab, (2012) 10 SCC 303 and Jitendra Raghuvanshi v. Babita Raghuvanshi, (2013) 4 SCC 58, the FIR No. 0374/2019 registered at Police Station: Vivek Vihar, Shahdara, Delhi under Sections 498A/406/34 IPC and all the proceedings emanating therefrom are quashed.
6.The parties shall abide by the terms of the settlement.
7.The petition is disposed of in the above terms.
