1.This petition has been filed for quashing of FIR No.284/2022 PS Hari
Nagar under Sections 498A/406 IPC on grounds of settlement arrived at between the parties through the facilitation of the Delhi High Court Mediation and Conciliation Centre dated 14[th] March, 2023 which is on record of this Court.
2.Petitioner No.1 and respondent No.2 were married on 21[st] April, 2015. One daughter was born out of wedlock.
3.Due to matrimonial discord, the marriage has resulted in divorce by decree dated 30[th] May, 2023.
4.The petitioner Nos.1-3 and respondent No.2/complainant are present in Court/through VC and duly identified by the IO.
5.Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No.284/2022 PS Hari Nagar under Sections 498A/406/34 IPC and proceedings emanating therefrom are quashed.
