1.The petitioner has filed the present petition, inter alia, praying as
under:-
“a) issue writ, order or direction in the nature ofmandamus directing to the respondents for the issuance ofcertificate of Vending (COV) to the petitioners as per thedirections given by the Secretary, Ministry of Housing andUrbanAffairs,GovernmentofIndialetterdated18.05.2021 having reference bearing no. D.O No. K-12017(30) /6/2020- UPA-II-Ud part(1) to the petitionerswho have been issued letter of Recommendation (LOR) byunder PM SVANidhi Scheme;”
2.Apparently, the relief sought for by the petitioner is for securing the
Certificate of Vending (COV) based on the Letter of Recommendation(LOR). The LOR placed on record indicates that this has been issued by theNorth Delhi Municipal Corporation. Clearly, no such LOR could have beenissued in respect of the area falling with the jurisdiction of New Delhi
Municipal Council.
3.Mr. Peechara, learned counsel appearing for the New Delhi MunicipalCouncil also submits that the petitioner had applied for LOR to New DelhiMunicipal Council and the same was rejected. The petitioner, thereaftersomehow secured the LOR from North Delhi Municipal Corporation, whichobviously would be of little benefit to the petitioner.
4.In view of the above, the relief as sought for by the petitioner cannotbe granted.
5.Accordingly, the petition stands dismissed. Pending application alsostands disposed of.
