1. The present petition is filed seeking setting aside of judgment dated 23.02.2023 vide which the challenge by the petitioner to the order dated 08.07.2022 passed by Mahila Court-05, Dwarka Courts, New Delhi, came to be dismissed.

2. Learned counsel for the petitioner submits that vide the initial order, Mahila Court had besides adjudicating upon the application for interim monetary relief under Section 12 of the Protection of Women from Domestic Violence Act, 2005, also granted the liberty to the petitioner to move an appropriate application with necessary particulars for seeking appropriate orders for right of residence. He further submits that subsequently, the petitioner hadpreferred an application in view of the aforesaid liberty, which also stands allowed. The same, however, is under challenge before the Sessions Court.

3. In view of the aforesaid development, he seeks leave to withdraw the present petition.

4. Learned counsel for the petitioner submits that the present withdrawal be not treated as withdrawal against the other reliefs sought in the

application under S.12 of the DV Act.

5. Ordered accordingly.
