Allowed, subject to all just exceptions.

W.P.(C) 5059/2024

1.When this Court observed that since the proceedings are pending before the Collector of Stamps for adjudication of the stamp and in view of the proceedings initiated by the Collector of Stamps, this Court would be hesitant to entertain the writ petition on merits, learned Counsel for the Petitioner very fairly prays for withdrawal of the present writ petition with direction to the Collector of Stamps to adjudicate the issue at the earliest because the sale deed has been impounded in the year 2022.

2.The request made by the Petitioner is reasonable one. The Collector

of Stamps is requested to dispose of the proceedings within period of three months from today.

3.Learned Counsel for the Respondent states that endeavour shall be made to dispose of the proceedings within three months’ time. The statement is taken on record.

4.The petition is disposed of as withdrawn along with pending application(s), if any.

5.It is made clear that no arguments have been advanced by the learned Counsel for the Petitioner on the merits of the case and the Collector of Stamps is directed to proceed ahead uninfluenced by the fact that the writ petition was not entertained only on the ground of alternate remedy.
