1.An application under Section 483 read with Section 528 of the

Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) has been preferred on behalf of petitioner for grant of regular bail in FIR No.59/2019 under Sections 365/302/34 IPC registered at P.S. Burari.

2.Issue notice. Learned APP for the State appears on advance notice and accepts notice.

3.Learned APP for the State points out that earlier Bail Application No. 1541/2023 preferred on behalf of petitioner was dismissed as withdrawn and the said fact has not been disclosed in the petition.

4.At this stage, learned counsel for the petitioner seeks to withdraw the application, with liberty to file afresh after enclosing earlier orders. 5.Taking the statement of learned counsel for the petitioner on record, application is accordingly dismissed as withdrawn with liberty to file afresh. Pending applications, if any, also stand disposed of.
