1.These petitions have been filed seeking anticipatory bail in FIR No.65/2022 at P.S. EOW, Mandir Marg under Sections
409/420/468/471/120B IPC. Petitioners were granted interim protection by order dated 11[th] July 2024 in the facts and circumstances as noted therein. Thereafter investigation continued.
2.According to petitioner’s counsel, they provided all documents, mobile phones, whatsapp chats etc. to the IO which is refuted by the APP who states that the mobile phone which was provided to the IO was in damaged condition and no other device has been provided to the IO.
3.Counsel for the petitioner further states that petitioner is willing to join and cooperate in the investigation and will provide mobile phone/ devices, money trails and documents, which may be requisitioned by the IO.
4.It is further noted that charge-sheet against co-accused Anshul Ahuja, Credit Manager, ICICI Bank has already been filed and charges have been framed. APP for the State further submits that supplementary charge-sheet is to be filed with respect to present petitioners.
5.Accordingly, subject to petitioners joining and cooperating in investigation and providing what is requisitioned by the IO, in the event of arrest the petitioners, they be released on bail on furnishing personal bond in the sum of Rs. 50,000/- each with one surety each of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioners will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case.
6.Accordingly, both these petitions are disposed of. Pending applications (if any) are disposed of as infructuous.
