1.The learned counsel for the petitioner seeks liberty to withdraw the present petition.

2.The trial relates to offences under Section 376 of the Indian Penal Code, 1860 and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act). The victim was stated to be 9 years of age at the time of alleged incident.

3.The Section 35(2) of the POCSO Act also mandates that the trial should normally be concluded within period of one year of the Trial Court taking cognizance of the offence. The chargesheet was filed in the present case way back on 22.10.2022.

4.The learned Trial Court is requested to expediate the recording of the evidence.

5.In view of the above, the applicant is at liberty to file an application afresh, if the trial does not conclude within period of six months.

6.The present application is dismissed as withdrawn with the

aforesaid liberty.
