1.The learned counsel for the applicant submits that, despite directions of this Court, the victim has not been examined before the learned Trial Court.

2.The learned Additional Public Prosecutor for the State submits that, on 01.02.2024, the learned Presiding Officer was on leave, even though the victim was produced for examination.

3.He submits that the matter is now fixed for examination of the victim on 26.03.2024.

4.The learned counsel for the applicant seeks liberty to withdraw the present application with liberty to file afresh after examinatin of the eye witnesses.

5.The application stands dismissed as withdrawn with the aforesaid liberty.
