W.P.(CRL) 1693/2024
1.Petition under Article 226 of Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (‘Cr.P.C.’) has been preferred on behalf of the petitioner with the following prayers:
“i. Direct the Respondents to conduct detailed inquiry in Complaint dated 18.04.2024 and to register an FIR in the said complaint immediately; and Complaint dated 18.04.2024 and to register an FIR in the said complaint immediately; and
ii. Issue writ, order or direction directing senior level Police officer not below the rank of Assistant Commissioner of Police to monitor the inquiry and to submit detailed report of inquiry before this Hon’ble Court.”
2.Issue notice. Learned ASC for State appears on advance notice and accepts notice.
3.Learned ASC for State on instructions submits that on the basis of representations/complaints received on behalf of family members of deceased and after obtaining opinion from the prosecution Branch, decision has been taken to register the FIR under Section 306/34 IPC.
4.Taking the statement of learned ASC for State on record, petition is accordingly disposed of with the directions to provide copy of the FIR to the petitioner within period of two weeks. Pending applications, if any, also stand disposed of.
