3.The present writ petition is filed under Article 226 of the Constitution of India, read with Section 482 of the Code of Criminal Procedure, 1973 (‘CrPC’), inter alia,seeking directions to Respondent No. 2 to expeditiously process the passport renewal application of the petitioner.

4.The learned counsel for the respondent, at the outset, points out that the application for such purpose can be considered in case an appropriate No Objection Certificate is obtained from the concerned Court where the criminal proceedings are pending.

5.He submits that, in the present case, the proceedings ae pending before the Court of learned Metropolitan Magistrate-01, South West District, Dwarka Court. He relies upon the Office Memorandum No. VI/401/1/5/2019 dated 10.10.2019.

6.In view of the above, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to approach the learned Trial Court and file an appropriate application.

7.The petition stands dismissed as withdrawn with the aforesaid liberty.

8.As and when any such application is filed, the learned Trial Court is requested to dispose of the same expeditiously.
