1.The learned counsel for the applicant submits that the matter is now listed on 28.02.2024 before the learned Trial Court for examination of the prosecutrix.
2.He submits that the applicant has been falsely implicated in the present case. He submits that the prosecutrix, despite several opportunities, has not been appearing before the learned Trial Court which has led to prolonged incarceration of the applicant.
3.The prosecutrix is present in Court and is also represented
by learned counsel.
4.The learned counsel for the prosecutrix submits that the proceedings were not adjourned at the instance of the prosecutrix. 5.The learned counsel for the applicant seeks liberty to withdraw the present application and file afresh after the examination of the prosecutrix.
6.The learned counsel for the prosecutrix assures that the prosecutrix would be present before the learned Trial Court on the next date of hearing for her examination.
7.In view of the above, the application stands dismissed as withdrawn with liberty to the applicant to approach again after the examination of the prosecutrix.
