1.These are petitions seeking grant of anticipatory bail in FIR No.0148/2025 dated- 16/02/2025, registered under section 109(1)/ 115(2)/126(2)/ 351(2)/ 61(2)/ 3(5) of BNS and 25/27 of Arms Act, at P.S.-Ranhola.
2.Both Sahil and Kuldeep are relatives and the disputes arose out of afamily settlement. The petitioners belonged to Kuldeep group and had analtercation with Sahil group who has also registered an FIR No. 0150/2025.
3.The allegations in both the FIRs are somewhat similar that theaccused persons had beaten the complainant and others with lathis andpelted stones. Most of the injuries are simple in nature except Sandeep, whosuffered grievous injuries.
4.Subsequently, the parties have arrived at compromise dated21.02.2025, wherein the members of both the groups have settled theirdisputes and do not wish to pursue the FIR any further. They have alsoagreed to cooperate in quashing of the FIRs.
5.The complainant is represented by Mr. Mohit Malik and has noobjection to the grant of anticipatory bail in view of the settlement.
6.I am of the opinion that no useful purpose would be served inprosecuting the FIRs any further on the ground that the parties have arrived
at voluntary settlement and have settled their disputes. Thus, it is fit caseto grant anticipatory bail.
7.However, I am of the view that the police machinery has been put inmotion on account of the acts of commission & omission on behalf of thepetitioners and useful time of the police which could have been utilised forimportant matters has been misdirected towards the present matter. Issuessuch as these end up wasting precious judicial time and state resources,ultimately affecting the society at large and negatively impacting judicialproductivity. Hence the petitioners must pay some costs.
8.Learned counsel for the petitioners state that they shall voluntarilymake donation to Delhi Police Welfare Society Fund. Hence, each of thepetitioners shall deposit sum of Rs. 5,000/- to Delhi Police WelfareSociety Fund within 2 weeks from today.
9.Since the matter has been settled, the petitions are allowed and in caseof any arrest, the petitioners be released on bail subject to their furnishing apersonal bond in the sum of Rs. 10,000/- with one surety of like amount tothe satisfaction of the concerned Investigating Officer and also subject to thefollowing further conditions:-
(i)At the time of furnishing bail bond, the petitioners shallprovide the mobile number, which they undertakes to keepoperational at all times during the pendency of the trial.provide the mobile number, which they undertakes to keepoperational at all times during the pendency of the trial.
(ii) The petitioners shall inform the concerned InvestigatingOfficer about their current residential address.Officer about their current residential address.
