1.This is petition under Section 482 Cr.P.C read with Section 528 of BNSS for quashing of FIR No. 178/2023 under Section 308/34 IPC registered at P.S.Maidan Garhi.
2.Mr. K.M.M.Khan, learned counsel appearing for the petitioners submits that both the petitioners have since been convicted by the trial court. Petitioner no.1 has been sentenced with imprisonment which is already undergone by him while petitioner no.2 has filed separate criminal appeal bearing no. CRL.A. 393/2025 which is already pending before this Court.
3.Learned counsel further submits that the judgment of conviction has been passed during the pendency of the present petition, and therefore, the present petition for quashing of FIR has become infructuous. He seeks permission to withdraw the petition with liberty to file appeal on behalf of
petitioner no.1.
4.The statement made by learned counsel is taken on record, and the petition is dismissed as withdrawn with liberty to file the appeal as per law.
