1. The accused/applicant seeks regular bail in case FIR No.117/2025 of PS Madhu Vihar for offences under Section 105/110 BNS. Broadly speaking, the allegation against the accused/applicant is that in congested area he was illegally constructing five storey building, which fell, causing death of one person and injuries to two others.

2. At the outset, learned counsel for accused/applicant seeks permission to withdraw this bail application.

3. But this case involves larger issues. It cannot be that the five storey building under construction came up overnight. In response to specific query IO/Inspector Sandeep Kumar submits that he is already investigating the role of the Junior Engineer, Assistant Engineer and other officers of MCD in this regard.

4. Therefore, at the request of learned counsel for accused/applicant, the bail application and accompanying applications are dismissed as withdrawn.
