3.The present petition has been filed by the petitioner being aggrieved by the installation of toll plaza on the Urban Extension Road-II (UER-II) within the territorial limits of NCT of Delhi, whereby toll charges are collected by the respondent no.3 from the commuters.

4.It is submitted that excessive toll fees is collected from the said toll plaza which is situated at Mundka – Bakkarwala Toll Plaza, near Munka Industrial Metro Station.

5.It is submitted that the petitioner is currently staying on rent at House No.10 Gali No. 9, Block Jai Vihar Phase 1 Nazafgarh, Delhi and has to

pass through the said toll plaza via Bakkarwala cut to reach his residence. It is submitted that an exorbitant charge of Rs. 235/- is levied on the petitioner each time he passes through the toll plaza.

6.Learned counsel for the respondent no.2/NHAI who appears on advance notice refutes the above contentions. He has produced the relevant Gazette Notification dated 20.08.2025 which expressly provides as under:-

“3. The rate of monthly pass for person who owns mechanical vehicle registered for non-commercial purposes and resides within distance of twenty kilometers from the fee plaza is Rs. 350 (Rupee Three Hundred and Fifty only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules.”

7.As such, it is submitted by the respondent no.2 that it is open to the petitioner to obtain monthly pass at the rate of Rs. 350 per month and upon obtaining such pass, the petitioner can pass through the toll on any number of occasions in month. It is further pointed out that dispensation of monthly pass has been created in terms Rule 9(3) of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

8.In the circumstances, this Court is not inclined to issue directions for removal of the toll plaza as sought in the present petition.

9.The petition is, consequently dismissed.
