1.First Bail Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner Arun for grant of Bail in FIR No. 232/2025 under Section 33/38/58 of Delhi Excise Act, registered at Police Station Swaroop Nagar, Delhi.
2.Essentially, the allegations are that two accused were apprehended in car, from which the elicit liquor was recovered. It is submitted that the Petitioner was one of the supplier of the illicit liquor.
3.Bail is thus sought, which is opposed by learned APP for the State on the ground that the Petitioner has failed to join the investigations and proceedings under Section 84 BNSS have already been initiated.
4.On specific query, it has been pointed out that the offence is punishable with imprisonment of three years.
5.In the light of the directions given in Arnesh Kumar, Investigating Officer (IO) is bound to first issue the notices under Section 35(3) of BNSS to the Petitioner to join the investigations.
6.Considering the conduct and that proceedings under Section 84 BNSS
