1. Allowed, subject to all just exceptions.

2. The petitioner has assailed an interlocutory order whereby the delay in filing the written statement of respondent was condoned by the learned Labour Court subject to payment of costs. By way of the impugned order, the learned Labour Court also framed issues since the petitioner submitted that he does not wish to file any replication/rejoinder. Even condonation of delay in the filing the written statement was ordered subject to costs.
3. After addressing partly, learned counsel for petitioner in the interest of expeditious disposal of the labour dispute seeks permission to withdraw this petition. However, learned counsel for petitioner apprehends that costs imposed in the impugned order might not be paid. But if that is so, certainly
the trial court would pass necessary orders consequential upon failure to pay costs.
4. As requested, the petition is dismissed as withdrawn. However, the learned Labour Court is requested to dispose of the proceedings as expeditiously as possible, keeping in mind the condonation of long delay in filing the written statement.
