1.The Petitioner is in custody in relation to FIR No. 444/2024 registeredunder Section 21 of the Narcotic Drugs and Psychotropic Substances Act,1985[1]at P.S. Bhalswa Dairy. Subsequently, chargesheet was filed qua thePetitioner under Sections 21/25/29 of the NDPS Act.
2.The Petitioner was granted interim bail by order dated 17[th]June,2025, passed by the ASJ-04, North District, Rohini Courts for period ofone week. Thereafter, the Petitioner filed another application under Section483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking extension ofinterim bail for period of 45 days. By order dated 25[th]June, 2025, theSessions Court partly allowed the request and extended the interim bail tilltoday.

3.The Petitioner is aggrieved that an extension of his request for 45 dayshas been partly allowed. He seeks extension of bail for further period of 30days.
4.In the opinion of the Court, since there is no adverse order decliningthe Petitioner’s request for extension of interim bail, the Petitioner should, atthe first instance, approach the Sessions Court to explain the groundsjustifying the extension sought.
5.Accordingly, the present petition is disposed of with liberty to thePetitioner to apply for extension of interim bail before the Sessions Courtwithin 3 days from today, in accordance with law. Such request shall thenbe considered on its own merits and in accordance with law.
6.In the meantime, the interim bail granted to the Petitioner is extendedtill Monday i.e. 7[th]July, 2025 on the same terms and conditions stipulatedby order dated 17[th]June, 2025. It is however clarified that this extension isonly to allow the Petitioner to avail the remedies of seeking extension beforethe Sessions Court. This Court has not expressed any opinion on the meritsof the case. All rights and contentions of the parties are left open.
7.The petition is disposed of along with pending application(s).
