1.This is an application seeking interim bail for period of 4 weeks inF.I.R No. 549/2017 under Sections 302/34 IPC and chargesheet u/s302/120-B/34 IPC & 27 Arms Act registered at Police Station NewUsman Pur on account of medical exigency.F.I.R No. 549/2017 under Sections 302/34 IPC and chargesheet u/s302/120-B/34 IPC & 27 Arms Act registered at Police Station NewUsman Pur on account of medical exigency.
2.The medical status report has been perused and the operative portionreads as under:reads as under:
“It is to be submitted that inmate patient is suffering frommultiple stones in Right Kidney with Hydronephrosis andseverely impaired Right Kidney Function. The inmatepatient gave complaints of Pain Abdomen repeatedly despiteprovidingmedications/treatment.AsthesymptomsofEpigastric Abdomen Pain with Colic Pain Continues, hewas referred to Safdarjung hospital for further management
The inmate has been advised Right DJ Stent PlacementSurgery. The inmate patient has been advised multipleinvestigations,blood.Urinetest.RadiologicalInvestigations for further assessment, he is also planned forCT Urogram at Safdarjung Hospital.”
3.No doubt that the petitioner is suffering from kidney issues andrequires medical intervention, however, as per the Nominal Roll dated04.01.2025, the petitioner was granted interim bail on 07.10.2024 till28.10.2024 wherein he did not surrender on expiry of the term andwas re-arrested/re-admitted to jail in the captioned F.I.R No.549/2019.
The petitioner has two more F.I.Rs pending against him. i.e. F.I.R No.42/2024 under Sections 25/54/59 Arms Act registered at PoliceStation Crime Branch and F.I.R No. 302/2016 under Sections25/54/59 Arms Act, registered at Police Station Seelampur.
Mr. Chadha, learned senior counsel, on instructions, states that he willbesatisfiedincasedirectionisissuedtothemedicaljailsuperintendent to ensure due care and adequate medical facility beingmade available to the petitioner.
The medical jail superintendent is hereby directed to ensure that themedical condition of the petitioner is looked after and due andappropriate medical treatment be provided to the petitioner.With these directions, the petition is disposed of.
