3.The present petition has been filed seeking following reliefs:
“a)Issue writ of or in the nature of mandamus directing theRespondent to refer the matter to Central Bureau ofInvestigation in accordance with the Vigilance Manual ofthe Central Vigilance Commission for investigation in atime bound manner;Respondent to refer the matter to Central Bureau ofInvestigation in accordance with the Vigilance Manual ofthe Central Vigilance Commission for investigation in atime bound manner;
b)Pass an order awarding cost of the present proceedings tothe Petitioner.”the Petitioner.”
4.Mr. Rahul Malhotra, learned counsel appearing on behalf of the
petitioner submits that he will not press the present petition any further incase direction is given to the respondent/DDA to treat the same asrepresentation and dispose of the same in time bound manner.
5.In view of limited innocuous prayer made by Mr. Malhotra, thepresent petition is disposed of with direction to the respondent/DDA toconsider the present petition as representation of petitioner, which will bedisposed of by the respondent/DDA by speaking order within period of10 weeks from today.
6.The order so passed by the respondent/DDA will be communicated tothe petitioner within period of two weeks thereafter.
7.Needless to say that the present order has been passed withoutprejudice to the rights and contentions of the present petitioner. Thepetitioner shall be at liberty to approach the court against the speaking orderpassed by the respondent/DDA, if so advised.
8.The petition is disposed of in the aforesaid terms. Consequently, thepending application also stands disposed of.
