1.The present petition has been filed under Article 226 of theConstitution of India read with Section 528 of the Bharatiya NagarikSuraksha Sanhita, 2023, seeking issuance of writ in the nature of HabeasCorpus to the respondents for production of the wife and minor son of thepetitioner before the Court.
2.The minor son along with his mother has been produced in the Court
today.
3.The Status Report has been handed across the board by the learnedStanding Counsel and the same is taken on record.
4.It is submitted that the wife of the petitioner, at present, does not wishto go to her matrimonial home; that her statement has already been recordedat Anand Vihar Police Station.
5.On being queried, the wife of the petitioner submitted that she is notwilling to go to her matrimonial house along with the petitioner, as she hasfaced domestic violence.
6.The learned counsel, at this stage, seeks permission to withdraw thepresent petition with liberty to file an appropriate petition before theappropriate forum.
7.Permission and liberty, as prayed for, in accordance with law, isgranted.
