Heard Mr. B. S. Parihar, learned counsel for the applicant and Mr. G. S. Sandhu, learned G.A. for the State.
Perused the record. According to the prosecution case, Prabhat Kumar (J.E.), Bhagirath and Chandra Yadav (line men) while discharging their official duty found that the accused applicant and co-accused have taken the illegal electric connection of light by using direct line. Thereafter, they cut down the said illegal electric connection. When they were collecting the wire, all the accused persons started assaulting them. It is in the statement that Bhagirath and Prabhat Kumar were caused injuries by Gurdeep (present applicant) and Chidar Singh. The injuries sustained by both of them are simple in nature. Co-accused Chidar Singh has already
been released on bail. Considering the facts and circumstances of the case, the applicant is entitled to get the bail on the ground of parity.
Let the applicant-accused be released on bail on executing personal
bond and two sureties each in the like amount to the satisfaction of the Magistrate concerned.
