Having heard upon the urgency application, the same is hereby allowed.

2. By way of this Criminal Miscellaneous Application, prayer has been made to quash the entire proceedings of Criminal Case No. 663/2007, State v. Daud & Others, pending before Additional Chief Judicial Magistrate, Haldwani, District Nainital.

2. Learned Counsel for the parties apprised this Court that the matter has been compromised and the parties have amicably settled their dispute. Copy of compromise has been annexed along with urgency application. Now, they do not want to proceed with any litigation in any Court pending between them.

3. Accordingly, in view of the proposition of law propounded by Hon’ble Apex Court in case of B.S. Joshi & Others v. State of Haryana & Another, reported in (2003) 4 SCC 675, which has been recently affirmed in case of Shiji @ Pappu & Others v. Radhika & Another, reported in (2012) 1SCC (Cri) 101, the compromise arrived at between the parties

is accepted. Impugned proceedings of Criminal Case No. 663/2007, State v. Daud & Others, pending before Additional Chief Judicial Magistrate, Haldwani, District Nainital are hereby quashed. Petition is disposed of accordingly.

4. Registry is directed to inform the court concerned accordingly.
