Learned counsel for the parties make statement that the parties have settled their disputes amicably. The proceedings of Sessions Trial No. 66 of 2007, captioned as State vs Alok Sharma and others, under Sections 498A, 323, 506, 315 of IPC and under Section ¾ of the Dowry Prohibition Act, pending in the court of learned Sessions Judge, Dehradun were quashed, vide order dated 03.08.2009, passed by this Court. Meenu Sharma was the wife and Alok Sharma was the husband. Learned counsel for the parties also stated that the marriage of Alok Sharma and Meenu was dissolved by decree of divorce. Permanent alimony of Rs. 4,00,000/- was given by Alok Sharma to Meenu Sharma. Entire stridhan was also returned.
2) In view of the fact that the parties have settled their disputes amicably and the complainant Meenu Sharma does not want to proceed with the
proceeding initiated by her against her in-laws under Protection of Women from Domestic Violence Act, the criminal revision is allowed with the consent of the parties. The impugned order dated 09.02.2007, passed by learned Chief Judicial Magistrate, Dehradun, in misc. criminal case no. 184 of 2006, captioned as Smt. Meenu vs. Alok Sharma and others under the Protection of Women from Domestic Violence Act as also the impugned order dated 02.03.2007, passed by learned Sessions Judge, Dehradun, in criminal appeal no. 7 of 2007, captioned as Alok Sharma and others vs State of Uttarakhand and another are hereby set aside.
