By way of present writ petition, the petitioner society seeks to issue direction for early disposal of misc. case no. 118 of 2013, pending before District Judge, Dehradun.
Expeditious disposal of any lis pending before any court is one of the fundamental rights of person as guaranteed under the Constitution of India and, therefore, it does not lie in one’s mouth to say that the pending litigation between the parties should be delayed. It is on account of this fact that this Court considers it fit to decide the present writ petition at the admission stage itself.
Heard learned counsel for the parties and considered the ground taken up by the writ petitioner in his writ petition.
Innocuous prayer made by learned counsel for the petitioner is worth accepting and is, therefore, accepted.
It is accordingly provided that learned District Judge, Dehradun shall make an endeavour to decide the pending application of the petitioner society moved under Section 5-A of the Societies Registration Act, 1860, in misc. case no. 118 of 2013, at an early date, as per law.
The writ petition is accordingly disposed of at the threshold.
