Mr. Kunal Sharma, Advocate holding brief of Mr. Abhishek Verma, Advocate present for the applicants. Mr. V.S. Pal, A.G.A. present for the State.
Merely because complainant (respondent no. 2 herein) is practicing advocate at Laksar district Haridwar, and he has filed criminal complaint case against the applicants, that cannot be ground for transfer of criminal complaint case pending before Additional Chief Judicial Magistrate, Laksar to any other court of district Haridwar or to any other district.
It does not appear that the applicants have approached the Sessions Judge, Haridwar or Chief Judicial Magistrate, Haridwar for transfer of such criminal complaint case to any other criminal court within the jurisdiction of district, Haridwar. Application under Section 407 Cr.P.C. is devoid of merits and is therefore dismissed.
