Applicants, who are in jail in connection with Case Crime No. 2/2015 relating to offences punishable under Sections 395 & 412 IPC, Police Station Pathri, District Haridwar, has sought their release on bail.

Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application. Counter affidavit filed on behalf of the respondent-State is taken on record.

An FIR was lodged against unknown miscreants for the offences under Sections 395 and 412 IPC on 4.1.2015 alleging therein that the accused persons caught hold off the people manning electricity establishment and looted six drums of cable wire. The electricity wire was allegedly recovered from the possession of the present applicants on 12.1.2015 and since then they are in jail. They are not previous convicts. No identification parade has been conducted as yet. The accused persons denied the recovery from them and said that they have been falsely implicated in the case.

It is the submission of learned counsel for the applicants that the applicants are ready to furnish reliable sureties to the satisfaction of Magistrate concerned if they are granted bail.

Considering the grounds taken up in the bail application, this court is of the opinion that the applicants should be enlarged on bail. Bail application is allowed.

Let the applicants be released on bail on their executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of t he Magistrate concerned.
