The applicant seeks bail in connection with FIR
no.2/2015 (Case Crime no.2 of 2015), under Sections 3, 6, 11 of Uttarakhand Protection of Cow Progeny Act, Section 11(d) of Animal Cruelty Act, P.S. Chorgalia, District Nainital.
Heard learned counsel for the parties, considered the grounds taken in the bail application and perused the documents on record.
According to the FIR, two oxen were being transported unauthorizedly by the accused persons, including the applicant, in vehicle (mini-truck/Chota Haati). Applicant has no previous criminal history. The FIR was lodged on 01.02.2015.
Considering the above facts and circumstances, case of bail is made out in favour of the present applicant. The bail application is allowed.
Let the accused-applicant be released on bail on his executing personal bond and furnishing two sureties, each of the like amount to the satisfaction of the Magistrate concerned.
