Mr. A.S. Gill, Dy. Advocate General assisted by Mr. V.S. Rathore, Brief Holder for the State.

Applicants namely Rupesh Kumar & Dileep Kumar, who are in jail in connection with case crime no. 20 of 2016 under Section 420, 467, 468 & 120-B of I.P.C., registered at Police Station-Kotwali Ranipur, District Haridwar, have sought their release on bail.

Heard learned counsel for the parties, considered the grounds taken up in the bail application and perused the documents brought on record.

An FIR was lodged on 21.6.2016 against 21 named accused persons including the present applicants, who were employees of the company of which accused nos. 1 to 4 were Directors, for the offences punishable under Section 420 IPC. Applicants are in jail since 03.03.2016.

It is the submission of the learned counsel for the applicants that co-accused namely Puja Mehra & Neetu having similar role have been granted bail by the coordinate bench of this Court vide order dated 16.6.2016 and co-accused namely Ravi Kumar and Sanjay Rai having similar role have been granted bail by this Court vide order dated 10.08.2016.

Learned Dy. Advocate General submitted that the applicants that the applicants have previous criminal history for which learned counsel for the applicants replied that applicants are not previous convicts.

Learned counsel for the applicants further submitted that the applicants are ready to furnish reliable sureties to the satisfaction of the court concerned, if they are granted bail.

Considering the overall facts and circumstances of the case, Bail application is allowed on the ground of parity.

Let the applicants namely Rupesh Kumar and Dileep Kumar be released on bail on their executing personal bond and furnishing two reliablesureties, each of like amount, to the satisfaction of the Magistrate concerned.

If at any point of time, it is found that the

applicants are misusing the bail, the learned Court below shall be at liberty to cancel their bail in accordance with law.
