Mr. Arvind Vashistha, Senior Advocate, assisted by Mr. K.R. Gazi, Advocate for the applicant.

Mr. K.S. Rautela, Government Advocate for the State.

This is an application seeking regular bail in Case Crime No. 29 of 2015, for the offence punishable under Section 364, 302, 201, 120B read with Section 34 of I.P.C., Police Station Clementown, District Dehradun.

Learned counsel for the applicant contends that there is no direct evidence against the applicant; entire prosecution story is roaming around the last seen evidence of Virendra Bhandari, even after, deceased was seen by the Virendra Bhandari in the company of Ombir Singh Tomar. Said Ombir Singh Tomar has already been granted bail.

In view of the above facts and circumstances of the case, as an interim measure, bail application is allowed.

Let the applicant be released on bail, on executing personal bond and furnishing two sureties, each of the like amount to the satisfaction of the Magistrate concerned.
