Mr. Kurban Ali, Advocate, present for the applicant.

Ms. Shivali Joshi, Brief Holder, present for the State.

Applicant Shah Alam, who is in jail in connection with Case Crime No. 09 of 2017, under Section 377 of IPC, PS Satpuli, District Garhwal, has sought his release on bail.

Heard learned counsel for the parties, perused the documents on record and considered the grounds taken up in the bail application.

The applicant was arrested on 02.08.2017 and

has no previous criminal history. The allegation against him is that he committed unnatural sex with calf.

Learned counsel for the State stated that if the applicant is granted bail he will flee away from the justice. On this, learned counsel for the applicant submitted that the applicant is ready to furnish reliable sureties if he is directed to be released on bail.

Considering the over all conspectus of things, as also the grounds taken up in the bail application, this Court is of the opinion that the applicant should be granted bail.

Bail application is allowed. Let the applicant be enlarged on bail on his executing personal bond and furnishing two reliablesureties of the like amount to the satisfaction of the Court concerned.

If at any point of time, it is found that the applicant is misusing the bail, learned court below shall be at liberty to cancel his bail in accordance with law.
