Applicant and respondent no. 1 are the real sisters. The applicant’s husband who was senior prosecuting officer is now no more in this mortal world while the husband of respondent no. 1 Shri Anand Pal Singh is practicing lawyer at Dehradun, so the civil litigation going on between the two in the Dehradun courts is under the influence of Shri Anand Pal Singh as has been claimed and alleged by Smt. Chaudhary.
She wants her case to be transferred at Kotdwar because no lawyer at Dehradun is available for her to make effective persuasion of the case while learned senior counsel on behalf of respondent no. 1 opposes vehemently the transfer of the case to Kotdwar on the ground that husband of Smt. Amlesh Chaudhary has once been posted as prosecuting officer in Kotdwar and I think such ground is unsubstantial and is ignored by the court.
After hearing both the parties, I transfer the original suit no. 147/2017 ‘Smt. Urmila Devi vs. Sachin Sharma & Others’ pending in the court of Civil Judge (S.D.), Dehradun to the court of Civil Judge (S.D.) at Kotdwar.
Petition finally stands disposed of.
