Learned counsel for the petitioner would submit that due to mistake on his part he has enclosed the wrong enclosure with the writ petition, therefore, he seeks permission to withdraw the writ petition with liberty to file afresh.
It appears that by filing the incorrect documents in support of contentions raised in the writ petition, which has resulted into wastage of large number of papers and in turn caused great harm to the environment, thus, it is directed that the writ petition be dismissed as withdrawn with liberty to file afresh subject to the condition that learned counsel for the petitioner or petitioner shall plant sapling, counsel for the petitioner shall undertakes to take care of the sapling in future.
At the time of filing of fresh writ petition, the learned counsel for the petitioner shall file photograph of said sapling planted by him or by the petitioner. It is made clear that the averment shall be made in this regard by filing an affidavit alongwith the writ petition.
