According to the learned counsel for respondent no. 2, the petitioner wanted to raise commercial construction in development area, for which he had moved an application before the Mussoorie Dehradun Development Authority (in short “MDDA”) for sanction of his map, which was rejected by the MDDA. Against the rejection of his application, the petitioner has already filed an appeal before the Commissioner, Garhwal Mandal, Camp Dehradun, which is still pending. Since the appeal of the petitioner is already pending before the Commissioner, Garhwal Mandal, Camp Dehradun, at this stage, no interference is being called for by this Court in the matter. The writ petition stands disposed with direction to the Commissioner, Garhwal Mandal, Camp Dehradun to decide the appeal of the petitioner, as expeditiously as possible, in accordance with law.
