...……Respondents

Present:

Mr. Ajay Veer Pundir, learned Advocate for the petitioner.

Mr. Paresh Tripathi, learned Chief Standing Counsel for the State of Uttarakhand/respondent nos. 1 & 2.

Dated: 12[th] June, 2019

Coram: Hon’ble Ramesh Ranganathan, C.J.Hon’ble Alok Kumar Verma, J.

Ramesh Ranganathan, C.J. (Oral)

The petitioner, Superintendent Engineer in the Public Works Department of the State of Uttarakhand, has invoked the jurisdiction of this Court questioning the punishment order imposed on him, by Principal Secretary Public Works Department in his order dated 21.05.2019.

2. The petitioner has an efficacious and effective alternative remedy of approaching the Public Services Tribunal under the provisions of the U.P. Public Services (Tribunals) Act, 1976, without exhausting which, he has invoked the writ jurisdiction of this Court.

3. As the petitioner has an effective alternative remedy, we see no reason to exercise discretion to entertain the writ petition. Leaving it open to the petitioner

to avail the remedy of approaching the public services tribunal questioning the impugned order, the writ petition fails and is, accordingly, dismissed. No costs.
