Pursuant to an FIR lodged by respondent no. 2 against the present applicant, which has been registered as F.I.R. No. 123 of 2017 at P.S. Raipur, District Dehradun, the Police conducted the investigation and submitted charge-sheet for the offences under Sections 420, 120-B, 506 I.P.C. against the applicant. Thereafter, learned Magistrate took cognizance in the matter and summoned the present applicant to face trial.

2. Considering the overall facts and circumstances of the case and the nature of offence, no interference is being called for by this Court in the matter. Consequently, this criminal miscellaneous application filed under Section 482 of Cr.P.C. stands dismissed.

3. Let the applicant appear before the Court concerned on or before 10.04.2019 and move bail application. It is made clear that as soon as the applicant appears before the Court below and moves bail application, the same shall be considered, as far as possible on the same day itself on its merit. In case, the bail application is deferred for any reason (including its rejection), the concerned Magistrate shall forward the papers to the Sessions Court for deciding the bail application on the same day.
