Heard Mr. Sandeep Kothari, Advocate for the petitioner.
Petitioner is appellant in Civil Appeal No. 63 of 2019, which he filed against dismissal of his suit vide judgment and order dated 23.05.2019.
According to the petitioner, he has filed an application in his Appeal seeking injunction against the defendants in the suit, who are respondents in the Appeal. The said application was filed by the petitioner on 27.05.2019. By means of this petition, petitioner has sought direction to learned appellate Court to expedite disposal of the injunction application.
Having regard to the facts and circumstances of the case, the present writ petition is disposed of with request to learned Appellate Court to decide the injunction application preferred along with Civil Appeal No. 63 of 2019, as expeditiously as possible, preferably within six months from the date of production of certified copy of this order.
Till disposal of the injunction application by the learned appellate Court, no third party interest shall be created qua the property in question.
