Applicant Vazid is in judicial custody in FIR No. 299 of 2020, under sections 307, 323, 504, 188, 336, 120B IPC and 51 (b) of the Disaster Management Act 2005, Police Station Kotwali Civil Line Roorkee, District Haridwar.
2. This matter is heard through Video Conferencing.
3. According to the FIR, four unknown persons attacked the injured Om Kumar on 09.05.2020 at 8:20 PM when he was returning home along with Vijender, Om Pal and Anuj.
4. Learned counsel for the applicant would submit that the applicant has been implicated on the basis of the statement of the co-accused, namely, Ali Hasan, who has already been granted in BA1 No. 1030 of 2020.
5. Learned counsel for the State would submit that since co-accused granted bail there is nothing to tell.
6. Having considered the submissions, this Court is of the view that the applicant deserves to be enlarged on bail.
7. The bail application is allowed. Let the applicant, namely, Vazid be released on bail, on executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
8. This bail order be forwarded to concerned Court as well as the concerned jail through e-mail also.
9. Urgency application IA No. 7421 of 2020 stands disposed of.
