Heard learned counsel for the parties
through video conferencing.
By means of this writ petition, petitioner
has sought following relief:
“A) Issue writ, order or direction in the nature of mandamus directing the respondent no. 1 to decide the representation of petitioner dated 26.06.2020 and 29.06.2020 (as contained in Annexure No. 11).”
According to the petitioner, District Development Authority has sanctioned house plan in favour of respondent no. 2 over land, in respect of which litigation is pending.
Learned counsel for the petitioner, therefore, submits that petitioner has made representations and Secretary, District Development Authority, Nainital be directed to take decision on the same. Learned counsel for respondent no. 1 assures the Court that Secretary, District Development Authority, Nainital will decide petitioner’s representation dated 29.06.2020, after hearing respondent no. 2, within eight weeks from the date of production of certified copy of this order alongwith copy of representation dated 29.06.2020.
The writ petition is, accordingly, disposed
of by recording the statement of learned counsel for respondent no. 1.
