Hon’ble Ravindra Maithani, J.

The applicant – Lokesh Kumar is in judicial custody in Case Crime No. 292 of 2020, under Sections 379 and 411 of I.P.C., Police Station-Pathri, District Haridwar. He has sought his release on bail.

2. Heard learned counsel for the applicant through Video Conferencing and learned counsel for the State.

3. Learned counsel for the applicant would submit that co-accused who was arrested from the spot has already been granted bail and it is case of parity.

4. Learned State counsel submits that the recovery has been made from the present applicant and not from the person who has been granted bail.

committing theft two persons were spotted; one was caught at the spot who was co-accused Anuj Kumar and granted bail, and according to F.I.R., the applicant managed to escape.

6. Having considered the fact this Court is of the view that it is fit case for bail.

7. The bail application is allowed.

8. Let the applicant – Lokesh Kumar be released on bail, on executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.

9. This bail order be forwarded to the concerned court as well as the concerned jail through e-mail also.
