Khulbe, J.**<br>Mr. Lokendra Dobhal, learned counsel for the<br>applicant.<br>Mr. Pankaj Joshi, learned B.H. for the State.<br>Counter affidavit filed by the State is kept<br>with the records. Application (IA 1/21) made<br>therefor stands disposed of accordingly.<br>Accused–Trepan Singh has sought his release<br>on bail in connection with Case Crime/FIR No.42 of<br>2020, u/s 27-A of the NDPS Act, registered at P.S.<br>Dharasu, Distt. Uttarkashi.<br>It is argued that the accused has been falsely<br>implicated; he is languishing in jail since 19.11.2020;<br>there is no criminal history nor any recovery against<br>the applicant; he is ready to furnish the sureties; and<br>he may be granted bail.<br>Per contra, learned State counsel opposed for<br>bail.<br>In this case, the accused Mandeep and Kashish<br>were apprehended by the police party on 10.7.2020;<br>102.828 kilograms of Doda powder was recovered<br>from their possession; their statement was recorded<br>and accordingly case was registered against them as<br>also the present accused; during investigation, no<br>credible evidence was collected by the I.O. except the<br>call details; there is no prima facie evidence u/s 27A<br>of the NDPS Act for financing;accordingly, without<br>making any comment on the merits, it is fit case<br>for bail at this stage.<br>The bail application is thus, allowed and the<br>applicant is directed to be released on bail on his<br>executing personal bond and furnishing two<br>reliable sureties, each of the like amount, to the<br>satisfaction of the Court concerned.<br>Pending application, if any, stands disposed<br>of.<br>**(R.C.
