Applicant Neeraj Singh Nainwal alias Nabbu is in judicial custody in FIR No.26 of 2021, under Section 8/21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, “the Act”), Police Station Kotwali Almora, District Almora. He has sought his release on bail.

2. Heard learned counsel for the parties through video conferencing and perused the record.

3. According to the case, on 17.03.2021, 6.78 gram Smack was recovered from the applicant.

4. It is submitted that the case is false; there is no independent witness; allegedly recovered quantity is just more than minimum quantity; applicant is not previous convict; he was involved in case when he was child, but he is out on bail in that case.

5. These facts are not disputed by the learned State counsel.

6. Having considered, under the facts and circumstances of the case, this Court is of the view that it is fit case for bail.

7. Bail application is allowed.

8. Let the applicant Neeraj Singh Nainwal alias Nabbu be released on bail, on his executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.

9. This bail order be forwarded to the concerned Court as well as the concerned jail through e-mail also.
