|||||BA1 No.838 of 2021 **Hon’ble R.C. Khulbe, J.** Mr. Sandeep Kothari, learned counsel for the applicant. Mr. Siddhartha Bisht, learned B.H. the State. Accused–Sunil Bhatt has sought his release on bail in connection with Case Crime/FIR No.22 of 2020, u/s 409/120-B IPC at P.S. Kotwali New Tehri, District Tehri Garhwal. It is argued that the accused has been falsely implicated; by order dated 15.3.2021, he was directed to be enlarged on bail by this Court u/s 408/420 IPC but he has been remanded u/s 409/120-B IPC by the Trial Court. Learned State counsel opposed for bail. Since the accused has been enlarged on bail u/s 420/408 IPC, he is also entitled for bail u/s 409/ 120-B IPC; accordingly, without making any comment on the merits, it is fit case for bail at this stage. The bail application is thus, allowed and the applicant is directed to be released on bail on his executing personal bond and furnishing two reliable sureties in the like amount, to the satisfaction of the Court concerned.
