Applicant Roop Singh @ Roopa is in judicial custody in FIR No. 165 of 2022, under Sections 8/21/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, P.S. Rudrapur, District Udham Singh Nagar. He has sought his release on bail.
2. Heard learned counsel for the parties and perused the record.
3. According to the prosecution case, on 13.03.2022, 91.50 gms. smack was recovered from the co-accused. It is he, who revealed that he would give this smack to the applicant.
4. Learned counsel for the applicant would submit that the person, from whose possession the smack was recovered, has already been granted bail.
5. Learned State Counsel admits it.
6. Having considered, this Court is of the view that it is case fit for bail and the applicant deserves to be enlarged on bail.
7. The bail application is allowed.
8. Let the applicant Roop Singh @ Roopa be released on bail, on his executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
