|||||WPMS No. 1818 of 2022<br>**Hon’ble Man oj Ku m ar Tiw ar i, J.**<br>Ms. Neetu Singh, learned counsel<br>for the petitioner.<br>Mr. Yogesh Tiwari, learned Standing<br>Counsel for the State of Uttarakhand.<br>Heard<br>learned<br>counsel<br>for<br>the<br>parties and perused the record.<br>Petitioner filed suit for specific<br>performance of an agreement to sell,<br>which is pending before learned Civil<br>Judge (S.D.), Roorkee, District Haridwar.<br>Along with<br>his<br>suit,<br>petitioner<br>filed<br>temporary<br>injunction<br>application,<br>however, no order has been passed on<br>the said application till date.<br>By means of this writ petition,<br>petitioner has sought direction to<br>learned trial court to expedite disposal of<br>his temporary injunction application.<br>Learned counsel for the petitioner<br>submits that all the defendants have<br>been served, however, they are not filing<br>objection<br>to<br>temporary<br>injunction<br>application and they are using all dilatory|

|tactics to delay the disposal of temporary|

|injunction application.<br>Having regard to the fact that all<br>the defendants have been served in the|
|suit, the writ petition is disposed of with|
|a request to court concerned to make|
|endeavour<br>to<br>decide<br>petitioner’s|
|temporary injunction application on the|
|next date fixed. If it is not possible to|
|dispose<br>of<br>temporary<br>injunction|
|application on the next date fixed, than|
|the same shall be disposed of on any|
